1. About these Terms

These Terms and Conditions govern your use of the website https://learnitwithmonica.com and your purchase and use of lessons, courses, learning materials and other services offered by Learn Italian With Monica.

Please read these Terms carefully before booking or purchasing a service.

By booking a lesson, purchasing a course, creating an account, submitting a booking request or otherwise using a paid service, you confirm that you have read and agree to these Terms and Conditions.

Nothing in these Terms affects your statutory rights as a consumer.

In these Terms, “Learn Italian With Monica”, “I”, “me” and “my” refer to the provider of the services.

“You”, “your”, “student” or “customer” refers to the person purchasing or receiving the services. Where the student is under 18, these expressions also include the parent or legal guardian who purchases or arranges the service.

3. Services

Learn Italian With Monica provides services that may include:

  • individual online Italian lessons;
  • lessons for two or more students;
  • group lessons and courses;
  • GCSE Italian preparation;
  • B1 Italian citizenship examination preparation;
  • conversation lessons;
  • downloadable learning materials;
  • recorded courses, workshops and digital resources;
  • consultations or introductory calls; and
  • other language-learning services described on the Website.

The precise content, duration, delivery method, price and availability of each service will be stated on the relevant Website page, booking page, invoice, course description or written agreement.

Unless expressly stated otherwise, live lessons are delivered online using Zoom or another suitable video-conferencing platform.

4. Eligibility and students under 18

You must be at least 18 years old to purchase services directly.

Students under 18 may receive tuition only where the booking has been made or authorised by a parent or legal guardian.

The parent or legal guardian is responsible for:

  • providing accurate information about the student;
  • ensuring that the student has suitable equipment and internet access;
  • ensuring that the student attends lessons at the agreed time;
  • making all required payments; and
  • communicating any relevant safeguarding, educational or accessibility requirements.

Lessons are not intended to replace appropriate supervision of a child. A parent or responsible adult should be reasonably available during online lessons involving a minor.

5. Information provided before purchase

The description of each service will set out, where applicable:

  • the main features of the service;
  • the lesson or course duration;
  • the delivery format;
  • the price;
  • any payment schedule;
  • any technical requirements;
  • any restrictions or prerequisites; and
  • any specific cancellation or refund conditions.

You are responsible for checking that a service is appropriate for your requirements before purchasing it.

6. Bookings and formation of the contract

A booking request does not automatically guarantee a lesson or course place.

A contract between you and Learn Italian With Monica is formed when:

  1. your booking or order has been accepted;
  2. any required payment has been received or an agreed payment arrangement has been confirmed; and
  3. you receive a booking confirmation, payment confirmation, invoice or other written confirmation.

I reserve the right to decline a booking before a contract is formed, including where:

  • the requested time is unavailable;
  • the service is unsuitable for the student’s stated needs;
  • incorrect or incomplete information has been provided;
  • a previous payment remains outstanding;
  • the student has previously seriously or repeatedly breached these Terms; or
  • I reasonably believe that accepting the booking would create a safeguarding, legal, professional or operational concern.

7. Prices

The price of each service will be displayed on the Website or communicated to you before you complete the purchase.

Unless otherwise stated, prices are shown in pounds sterling.

Learn Italian With Monica reserves the right to change prices at any time. A price change will not normally affect lessons, packages or courses that have already been purchased and paid for.

Where a continuing or recurring arrangement is affected by a price change, reasonable advance notice will be provided before the new price takes effect.

Any special offer, discount or promotional price may be subject to additional conditions and may be withdrawn at any time before a purchase is completed.

Discount codes have no cash value and cannot be exchanged for money.

8. Payment

Payment must be made using one of the payment methods displayed on the Website, booking platform, payment link or invoice.

Depending on the service, payment may be required:

  • at the time of booking;
  • before the lesson takes place;
  • in instalments;
  • through a recurring payment arrangement; or
  • by another payment schedule agreed in writing.

You are responsible for ensuring that payment information is accurate and that sufficient funds are available.

Where payment is made through a third-party provider, such as PayPal, Stripe, a card processor or a booking platform, that provider may apply its own terms and privacy policy to the processing of the payment.

Learn Italian With Monica does not normally receive or store your complete payment-card details.

If a payment is declined, reversed or remains overdue, I may suspend access to lessons, courses, digital materials or future bookings until payment has been received.

9. Lesson packages and course places

Where you purchase a package of lessons, the number of lessons and any validity period will be confirmed at the time of purchase.

Lesson packages:

  • may be used only by the named student or students;
  • may not be transferred to another person without prior written agreement;
  • may not be exchanged for cash; and
  • must be used within any validity period stated at the time of purchase.

Where a course has fixed dates, purchasing a place reserves that place for the student. Missing a scheduled group session does not normally entitle the student to an individual replacement lesson, refund or reduction in price unless this has been expressly agreed.

Any recordings, notes or replacement materials offered following a missed group session are provided at my discretion unless they form part of the advertised course package.

10. Scheduling lessons

Lesson times must be agreed through the Website, booking system, email or another method approved by Learn Italian With Monica.

All times will be interpreted using UK local time unless another time zone is expressly stated.

Students located outside the United Kingdom are responsible for checking the time difference, including changes caused by daylight saving time.

You are responsible for attending the lesson at the correct time.

11. Student cancellations and rescheduling

You may cancel or request to reschedule an individual lesson by contacting me or using the relevant booking-system function.

Unless a different cancellation policy was clearly provided when you booked:

  • at least 24 hours’ notice is required to cancel or reschedule an individual lesson without charge;
  • where at least 24 hours’ notice is given, the lesson may be rearranged subject to availability;
  • where less than 24 hours’ notice is given, the lesson will normally be charged in full or deducted from the student’s lesson package; and
  • failure to attend without notice will normally be treated as a completed lesson and will not be refunded.

The cancellation period is calculated from the scheduled starting time of the lesson.

Exceptions may be considered for genuine emergencies or exceptional circumstances, but any exception is discretionary and does not create an obligation to offer the same exception in the future.

For group courses, workshops, fixed programmes and special events, separate cancellation conditions may apply. These will be communicated before purchase.

12. Late arrival

If a student arrives late, the lesson will normally still end at the original scheduled finishing time.

No refund or additional time will normally be provided for time lost because of the student’s late arrival, technical difficulties or failure to attend.

If a student has not joined the lesson within 15 minutes of the scheduled start time and has not contacted me, the lesson may be treated as a missed lesson and charged in full.

13. Cancellations by Learn Italian With Monica

I may occasionally need to cancel or rearrange a lesson because of illness, an emergency, technical problems or other circumstances outside my reasonable control.

Where I cancel a lesson, I will offer one of the following:

  • a replacement lesson;
  • a credit towards a future lesson; or
  • a refund for the lesson that I cancelled.

I will not be responsible for additional losses or expenses caused by a cancellation, such as childcare costs, travel costs, lost earnings or the cost of alternative tuition.

Nothing in this clause limits liability where it would be unlawful to do so.

14. Online lesson requirements

You are responsible for providing:

  • a suitable computer, tablet or other compatible device;
  • a stable internet connection;
  • a working microphone and, where required, camera;
  • access to the agreed video-conferencing software;
  • an appropriate email address; and
  • a quiet and suitable learning environment.

You should test your equipment before the lesson.

I am not responsible for lesson time lost because of problems with the student’s equipment, software, internet connection or local power supply.

Where a significant technical problem originates from my equipment or systems and prevents the lesson from being delivered, I will offer a reasonable replacement, credit or refund.

15. Behaviour during lessons

Students must behave respectfully and appropriately.

The following are not permitted:

  • abusive, threatening, discriminatory or harassing behaviour;
  • inappropriate sexual comments or conduct;
  • deliberate disruption of a lesson;
  • unauthorised recording or distribution of lesson content;
  • sharing offensive or unlawful material;
  • impersonating another person;
  • misuse of lesson links or account credentials; or
  • any behaviour that creates a safeguarding concern.

I may end a lesson immediately where a student’s behaviour is seriously inappropriate.

In serious or repeated cases, I may terminate the tuition arrangement. No refund will be provided for a lesson ended because of serious misconduct. Any refund for unused future lessons will be considered in light of the circumstances and applicable consumer law.

16. Learning outcomes and examination results

I will provide tuition with reasonable care and skill and will make reasonable efforts to support the student’s learning goals.

However, individual progress depends on factors including:

  • attendance;
  • participation;
  • previous knowledge;
  • independent study;
  • completion of assigned work;
  • motivation;
  • examination performance; and
  • the amount of time available.

I cannot guarantee:

  • fluency within a particular period;
  • a specific grade or examination result;
  • success in a citizenship or language examination;
  • acceptance by a school, university, employer or public authority; or
  • any other particular personal, academic or professional outcome.

Any study plan, estimated learning timescale or predicted result is guidance only and is not a guarantee.

17. Examinations and official requirements

Information about GCSE examinations, citizenship requirements, language certificates or other official processes is provided for educational purposes.

Examination boards, government departments, consulates and other organisations may change their requirements.

Students are responsible for checking current official requirements, examination dates, registration procedures, fees and eligibility conditions with the relevant organisation.

Learn Italian With Monica is not an examination board, immigration adviser or government body and does not guarantee that a student will satisfy any official requirement.

18. Consumer cancellation rights

Where you are a consumer and purchase a service online, by telephone or through another distance-selling method, you may have a legal right to cancel the contract within 14 days without giving a reason.

The cancellation period normally expires 14 days after the day on which the contract is formed.

To exercise this right, you must send a clear statement of cancellation to:

You may use the model cancellation form at the end of these Terms, but you are not required to do so.

Services beginning during the 14-day cancellation period

If you ask for lessons or another service to begin during the 14-day cancellation period, you expressly request early performance of the service.

If you later cancel within the 14-day period, you may be required to pay a proportionate amount for any service already supplied before you communicated your cancellation.

Where a service has been fully performed during the 14-day cancellation period, your right to cancel may be lost if:

  • you expressly requested that performance begin during the cancellation period; and
  • you acknowledged that you would lose the cancellation right once the service had been fully performed.

Digital content supplied immediately

Where you purchase digital content that is not supplied on a physical medium, such as a downloadable worksheet, recorded course or digital resource, immediate access may be provided only after you:

  • expressly consent to the digital content being supplied before the end of the 14-day cancellation period; and
  • acknowledge that you will lose your cancellation right once supply begins.

These provisions do not affect your rights where a service or item of digital content is faulty, misdescribed or not supplied as agreed.

19. Refunds

Refund eligibility depends on the service purchased, the reason for the request, any statutory cancellation rights and the amount of the service already provided.

Where a refund is legally due, it will normally be made using the original payment method unless otherwise agreed.

Refunds for unused lesson packages or courses requested outside the statutory cancellation period are not automatic.

I may consider a discretionary refund or credit where:

  • a long-term medical issue prevents the student from continuing;
  • a substantial change in circumstances makes continued tuition impracticable;
  • I am no longer able to provide the remaining service; or
  • another exceptional situation makes a refund reasonable.

Any lesson already delivered, missed without sufficient notice or cancelled late may be deducted from the refund.

Reasonable non-recoverable transaction charges may be deducted only where legally permitted and clearly disclosed.

20. Digital products and learning materials

Digital materials are licensed to the purchaser for personal, non-commercial educational use only.

You must not, without prior written permission:

  • copy or reproduce the materials for other people;
  • upload them to another website or platform;
  • share login details or download links;
  • sell, license or redistribute them;
  • remove copyright notices;
  • adapt them for commercial use;
  • use them to create a competing course or teaching product; or
  • publish lesson recordings, slides, exercises or answer keys.

Teachers, schools and organisations wishing to use materials with multiple students must obtain separate written permission or an appropriate licence.

21. Intellectual property

All original content available through the Website or services, including lesson materials, worksheets, exercises, course structures, videos, audio recordings, graphics, logos, written content and teaching resources, is owned by or licensed to Learn Italian With Monica.

All intellectual property rights are reserved.

Purchasing a lesson, course or resource does not transfer ownership of the intellectual property to you.

You receive only the limited right to use the material for your own learning in accordance with these Terms.

22. Recording lessons

You must not record, photograph, screenshot, stream or otherwise reproduce a lesson without my prior written permission.

I will not record a private lesson without informing you and obtaining any consent required by law.

Where a group lesson or course is recorded, this will be explained in advance. Students may be offered reasonable options regarding camera use or participation where appropriate.

Recordings supplied to students remain protected by copyright and must not be shared, downloaded, edited, republished or made available to anyone who is not authorised to access them.

23. Third-party platforms and external links

The Website or services may use or link to third-party platforms such as:

  • Zoom;
  • Google services;
  • email providers;
  • calendar and booking systems;
  • payment processors;
  • video-hosting platforms;
  • learning platforms; and
  • social-media services.

These third parties operate independently and may apply their own terms, privacy policies and technical requirements.

I am not responsible for the content, availability, security or actions of third-party websites or platforms, except to the extent that responsibility cannot lawfully be excluded.

A link to another website does not mean that I endorse all content available on that website.

24. Website availability

I aim to keep the Website accurate and available, but I do not guarantee uninterrupted or error-free access.

The Website may occasionally be unavailable because of:

  • maintenance;
  • technical faults;
  • cybersecurity incidents;
  • hosting-provider issues;
  • updates; or
  • circumstances outside my reasonable control.

I may change, suspend or withdraw Website features where reasonably necessary.

25. Accuracy of website information

Reasonable care is taken to ensure that information on the Website is accurate when published.

However, general educational articles, blog posts, social-media content and free resources may not always reflect the latest examination, immigration, citizenship or institutional requirements.

You should verify time-sensitive official information directly with the relevant authority.

Images and visual examples are illustrative and may appear differently depending on your screen or device.

26. Testimonials and reviews

Testimonials and reviews may be displayed on the Website or on associated profiles.

Reviews represent the experiences and opinions of individual students and do not guarantee that every student will achieve the same result.

Where a testimonial has been provided in exchange for an incentive, discount or other benefit, this will be disclosed where required.

You must not submit a review that is knowingly false, unlawful, defamatory, abusive or infringes another person’s rights.

27. Privacy and personal information

Personal information is handled in accordance with the Privacy Policy published on the Website.

The Privacy Policy explains matters including:

  • what personal information is collected;
  • why it is collected;
  • the lawful basis for processing;
  • how long information is retained;
  • when information may be shared;
  • your data-protection rights; and
  • how to raise a concern.

These Terms and Conditions do not replace the Website’s Privacy Policy or Cookie Policy.

28. Limitation of liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory consumer rights; or
  • any other liability that cannot lawfully be excluded or limited.

Subject to the above, Learn Italian With Monica will not be responsible for losses that:

  • were not reasonably foreseeable when the contract was formed;
  • were caused by inaccurate information supplied by you;
  • resulted from your failure to follow reasonable instructions;
  • arose from your equipment, software or internet connection;
  • resulted from the acts or systems of an independent third party;
  • were caused by circumstances outside my reasonable control; or
  • relate to business losses where you purchased the service as a consumer.

If you purchase services wholly or mainly for business purposes, I will not be liable for loss of profit, revenue, business opportunity, goodwill, anticipated savings or indirect or consequential loss.

Any limitation of liability will apply only to the extent permitted by law.

29. Events outside reasonable control

I will not be responsible for delay or failure to provide a service caused by circumstances outside my reasonable control.

Such circumstances may include:

  • serious illness or emergency;
  • failure of internet or telecommunications services;
  • power failure;
  • cybersecurity incidents;
  • natural disasters;
  • government restrictions;
  • industrial action;
  • transport disruption; or
  • failure of an essential third-party platform.

Where possible, I will contact affected customers and take reasonable steps to minimise the disruption.

30. Termination

You may stop purchasing future lessons at any time, subject to:

  • payment of any outstanding amount;
  • the cancellation conditions applying to booked lessons;
  • the terms of any fixed course or package; and
  • any applicable statutory rights.

I may terminate the tuition arrangement where:

  • payment remains overdue;
  • the student repeatedly fails to attend;
  • there is serious or repeated inappropriate behaviour;
  • trust and cooperation have broken down;
  • the student misuses learning materials;
  • continuing tuition would create a safeguarding concern; or
  • I am no longer reasonably able to provide the service.

Where I terminate an arrangement for reasons unrelated to wrongdoing by the student, I will refund or credit any prepaid service that will not be supplied.

31. Complaints

Please raise any concern as soon as reasonably possible so that I have an opportunity to investigate and resolve it.

Please include:

  • your name;
  • the service purchased;
  • the date of the relevant lesson or purchase;
  • a clear description of the problem; and
  • the outcome you are seeking.

I aim to acknowledge complaints within two working days and provide a substantive response within 14 working days where reasonably possible.

32. Alternative dispute resolution

If a consumer complaint cannot be resolved directly, I will provide information about any appropriate Alternative Dispute Resolution provider where I am legally required to do so.

Unless expressly confirmed otherwise, Learn Italian With Monica is not obliged to participate in a particular Alternative Dispute Resolution procedure.

This does not affect your right to bring legal proceedings.

33. Changes to these Terms

I may update these Terms from time to time because of:

  • changes in the services;
  • changes in payment or booking systems;
  • changes in law or regulatory guidance;
  • security requirements; or
  • operational changes.

The version applying to your purchase will normally be the version in force when the relevant contract was formed.

Any updated Terms will be published on the Website with a revised effective date.

Changes will not retrospectively remove rights you have already acquired.

34. Transfer of rights

You may not transfer your rights or obligations under a contract with Learn Italian With Monica to another person without prior written permission.

I may transfer my rights or obligations only where this does not reduce your statutory or contractual rights.

35. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect.

Where possible, the affected provision will be interpreted or adjusted only to the minimum extent necessary to make it valid and enforceable.

36. No waiver

If I do not immediately enforce a provision of these Terms, this does not mean that I have waived the right to enforce it later.

37. Third-party rights

Unless expressly stated otherwise, no person other than you and Learn Italian With Monica has any right to enforce the contract under the Contracts (Rights of Third Parties) Act 1999.

38. Governing law and jurisdiction

These Terms and any contract between you and Learn Italian With Monica are governed by the laws of England and Wales.

If you are a consumer resident in another part of the United Kingdom, you may also benefit from mandatory protections available under the law of the country in which you live.

Consumers may bring legal proceedings in the courts available to them under applicable consumer law.

Where you purchase services for business purposes, the courts of England and Wales will have exclusive jurisdiction, unless otherwise agreed in writing.

Before publishing it, check these four points:

  1. Business status: Replace the wording if Learn Italian With Monica is a limited company rather than your sole-trader trading name.
  2. Cancellation notice: I used 24 hours.
  3. Lesson packages: Add a validity period only if your packages expire.
  4. Payments and subscriptions: Add the names of the payment and booking platforms you actually use, particularly if you introduce recurring memberships.

You will also need a separate Privacy Policy and Cookie Policy. A privacy notice is a distinct UK GDPR requirement and should explain what information you collect, your lawful bases, retention periods, recipients and the individual’s rights. (Information Commissioner’s Office)

This is a practical website draft rather than advice from a solicitor. Because cancellation rights and subscription rules are legally sensitive and UK consumer rules continue to develop, professional review is advisable before you begin taking automated payments or selling long-term subscriptions.
